Lawsuit Against Zango Dismissed; Gloating Ensues

Zango is an adware firm; there is some evidence that the company's products tend more towards the "spyware" side of things. A class-action lawsuit against the entity (and on that subject) was dismissed yesterday. Zango issued a press release about it, and handled the matter in a not-exactly-polite way.

Techdirt reported on the matter. "The dismissal of a single lawsuit (and the details are missing as to why it was dismissed) doesn't necessarily justify the business model - and the fact that the company views some pretty serious, and very detailed, complaints from an awful lot of people as ‘background noise' should hopefully alert advertisers that this is not a company to work with," wrote Mike.

The "background noise" comment that he mentioned came from the none other than Zango's CEO. "Despite occasional distractions like this unfounded lawsuit and the background noise of a small group of fixated critics, I'm very proud of the fact that our desktop advertising business continues to grow and progress nicely," stated Keith Smith, the CEO in question.

One has to wonder if those "occasional distractions" include the time "an affiliate who had been posting Zango content on MySpace against both companies' terms of service . . . switched to using a new domain, despite Zango's public claims that such activity would result in the termination of the affiliate account" (as reported by our David Utter).

The "group of fixated critics" created by that mess was not "small," though, so perhaps Smith was referring to something else. Oh, and the Zango CEO probably shouldn't worry that, as Techdirt mentioned, "this comes just days after security firm Sunbelt Software declared Zango's search assistant one of the most insidious spyware apps around for the month of August."
