A New Hampshire woman pleaded guilty in Arizona federal court and faces up to 15 years in the penitentiary for violations of the CAN SPAM Act, in the form of distributing pornographic spam.

The Justice Department charged Jennifer Clason, 33, with creating and transmitting pornographic spam for Jeffrey A. Kilbride, 39, of Venice, California and James R. Schaffer, 39, of Paradise, Arizona.

The DoJ got involved when AOL users lodged more than 600,000 complaints in the first six months of 2004. Clason was charged with two counts of violating the CAN SPAM Act and one count of criminal conspiracy.

Interestingly enough, Clason ran a forum website for helping working moms to get out of the office and work from home. Her site, Mommyjobs.com ran numerous articles from Clason talking about running an Internet based business from home for more than seven years and says she owns more than 10 Internet sales sights.

"It's sickening to think that a woman claiming to help other mums generate an income while looking after their children was also involved in spam campaigns that promoted adult pornographic websites. The US computer crime authorities are cracking down harder than ever on those responsible for sending spam, and they should be congratulated for bringing another culprit to justice," said Graham Cluley, senior technology consultant for Sophos. "Firm action is required worldwide to send a strong message to spammers that their activities are simply unacceptable."

Clason's got a while to stew over this whole fiasco, as her sentencing isn't until June 5th. Her co-conspirators, Kilbride and Schaffer go to trial on June 6th. The charges against them are a little stiffer though.

They were charged with two counts of interstate transportation of obscene material using an interactive computer service; two counts of interstate operation of obscene material for the purpose of sale or distribution and one count of money laundering. This is in addition to the other charges.

Schaffer also got tagged with operating three pornographic web sites without required statements describing the location of identification and other records on the performers featured on the site. Not doing these things is against federal law.

This is almost funny…almost. Ms. Clason, is facing real prison time. She's also agreed to pay back all the profits she got from the porno spam thing. The tough part will be sweating this out until June along with her family.
