A British teenage charged with attacking his former employer through an email denial of service (DoS) attack walked away after the judge ruled current UK law didn't cover this type of attack.
The Computer Misuse Act, passed back in 1990 is considered old and outdated. This point was argued by the boy's attourney and agreed to by District Judge Kenneth Grant, ruling from the Wimbledon magistrates' court. The court said the DoS had not broken the law.
Apparently, the facetious youth was accused of sending five million emails in order to crash the old bosses server. He was charged under section 3 of the law, covering "unauthorized data modification and system tampering."
According to Computer Weekly, the IT and telecom industry lashed out, with Cable and Wireless saying the Computer Misuse Act needed to be overhauled. The industry called for MPs to begin working on the new law.
